Yhdysvaltain presidentti Donald Trump on tunnettu ahkerana twiittailijana. Nyt häntä vastaan on nostettu kanne, koska hän on syytösten mukaan rikkonut Yhdysvalloissa tiukkaa Presidential Records Actia. Laki velvoittaa presidentit säästämään kaikki kirjeenvaihtonsa. Asian nosti esille mm National Security Archive.
Trump on poistanut presidentin ominaisuudessa lähetettämiään twiittejä, mutta hän on myös käyttänyt hallintonsa toimissa viestintää, joka ei tallennu arkistoitavaksi. Historiantutkimuksen kannalta tämä on luonnollisesti harmillista.
Yhdysvaltojen kongressi sääti Presidential Records Actin 1978 kun presidentti Richard Nixon oli yrittänyt pitää itsellään virkatoimiensa aikana syntyneitä dokumentteja. Clintonin hallinnon aikana vuonna 1994 luotiin ensimmäinen automatisoitu järjestelmä sähköpostien arkistointiin, mutta järjestelmä ei toiminut kunnolla vaan lukuisia posteja jäi tallentamatta. Bushin hallinnon aikana järjestelmää muutettiin mutta se oli edellistä epäluotettavampi ja niinpä puolentoista vuoden aikana 2003-2005 miljoonia viestejä katosi. Lisäksi Bushin hallinnon virkailijoista (mm Karl Rove) kierrättivät viestiliikennettä rebuplikaanipuoleen servereiden ja tilien kautta.
Yhdysvaltalaiset historioitsijat tekivätkin vuonna 2008 vetoomuksia senaatille ja kongressille, joissa vaadittiin Presidential Records Actin tiukennusta.
Laki velvoittaa presidenttiä
“take all such steps as may be necessary to assure that the activities, deliberations, decisions, and policies that reflect the performance of his constitutional, statutory, or other official or ceremonial duties are adequately documented and that such records are maintained as Presidential records.”
Aikaisemmin Georg W. Bushin ja Hillary Clintonin sähköposteista on myös noussut kohu-uutisia.NPR kirjoitti:Two government watchdog groups, Citizens for Responsibility and Ethics in Washington and the National Security Archive, filed a lawsuit Thursday against President Trump and the Executive Office of the President.
The complaint alleges that White House staffers' widely reported use of encrypted messaging apps, such as Signal and Confide, for internal communication violates the Presidential Records Act.
In the lawsuit, the groups claim the Trump administration has "failed to adopt adequate policies and guidelines to maintain and preserve presidential records."
Encrypted messaging apps automatically delete messages, which would prevent those communications from being archived.
"The American people not only deserve to know how their government is making important decisions, it's the law," CREW Executive Director Noah Bookbinder said in a statement. "By deleting these records, the White House is destroying essential historical records."
